The facts will be stated only so far as necessary for disposition of these motions; a fuller statement may be found in the opinion of the District Court reported in Barnett v. Equitable Trust Co., 21 F.(2d) 325. Briefly, suit was brought by Barnett, a full-blooded Creek Indian, by his next friend, against the Equitable Trust Company of New York and the American Baptist Home Mission Society, to set. aside as void, because of Barnett’s mental incompetence, an attempted gift by him of United States Liberty Loan Bonds of the par value of $550,000.
