This is an action for negligence. It was here once on demurrer to the declaration, and is reported in 80, Vt. 1, 66 Atl. 801.
The alleged negligence of the lighting company is, the erection of a line of electric light and power wires of high voltage above, and in dangerous proximity to, the telephone company’s line, by reason of which the plaintiff, an employee of the telephone company, in the performance of his duty as lineman, in adjusting wires to the crossarms on a telephone pole below and near the power wires, came in contact with them, and was burned and injured.
