MONROE, J.
Plaintiff recovered judgment against defendant in the sum of $5,000, as punitory, and $500, as actual, damages, found to have been sustained by reason of the wrongful issuance of an injunction, also directing defendant to render 'an account, and reserving plaintiff’s right thereupon to claim other damages. Defendant was granted a suspensive appeal, which was made returnable to this court on June 23, 1913, and filed the required bond.
