Plaintiff, Robert Ben Luft, filed an action against defendant, Lloyd W. Schoenhoff, to recover damages for unjust enrichment and fraud and to impose a constructive trust. The case was tried to the court with both parties represented by counsel. The trial court entered judgment on all counts in plaintiffs favor, awarding plaintiff $354,-366.43 in actual damages and interest and $50,000.00 in punitive damages and imposing a constructive trust.
