This is an action of tort. The declaration is in two counts, one for the death and the other for the conscious suffering of the plaintiff’s intestate, who was run down by the *232defendant’s motor truck while crossing a street in Cambridge. The defendant’s motion for a directed verdict was denied and there was a verdict for the plaintiff on both counts.
