Defendant-Appellant Peter Moses (Moses) appeals the February 24, 2004 Judgment reinstating his convictions in the Circuit Court of the First Circuit (circuit court).

On appeal, Moses contends the circuit court “clearly erred when it found that Moses had waived his physician-patient privilege because Moses neither voluntarily disclosed nor consented to the disclosure of his toxicology report.” In the alternative, Moses contends he was “denied the effective assistance of counsel because [his] trial counsel provided the prosecution with a copy of the toxicology…
