This matter is before the Court upon the Amended Motion for Summary Judgment (Doc. 11) (“Amended Motion”) filed by William Todd Drown, Trustee (hereinafter “Plaintiff’), the response (Doc. 13) to the Amended Motion filed by CIT Group/Consumer Finance Inc.
