This is an action of contract commenced by writ dated October 6, 1930. The action is brought for the benefit of the Massachusetts Bonding and Insurance Company to recover the proceeds of a check for $24,000 of the plaintiff corporation alleged to have been improperly used by one of its officers for the purpose of paying an individual indebtedness to the defendants. It is alleged that the defendants were not bona fide purchasers of the check.
