This is an appeal from a partial summary judgment granted by the Jefferson Circuit Court. The court dismissed a claim seeking an adjudication that an award of punitive damages against an underinsured third-party tortfeasor would fall within the coverage provided by the underinsured motorist (UIM) provisions of appellants’ motor vehicle liability insurance policy issued by appellee Allstate Insurance Company (Allstate).
