This appeal arises out of a collision which occurred at approximately 4 a.m. on September 29, 1972 at a railroad crossing on North Point Boulevard in Baltimore County, involving a locomotive owned by appellee, Canton Railroad Company (Canton), and a tractor-trailer owned and operated by appellant, Robin Express Transfer, Inc. (Robin). Canton filed suit against Robin based upon negligence in the truck’s alleged failure to stop for a red traffic signal.
