This appeal represents the second time this case has come before this Court.

On September 28, 1982, defendant, Curtis Sutton, pled guilty to assault with intent to commit the crime of murder, MCL 750.83; MSA 28.278, felonious assault, MCL 750.82; MSA 28.277, and possession of a firearm during the commission of a felony, MCL 750.227b; MSA 28.424(2). On October 12, 1982, defendant was sentenced by Detroit Recorder’s Court Judge Donald L.
