This is an action for the foreclosure of a mortgage on a quarter section of land in Stutsman county. The prime question is one of priority between the mortgage and a judgment lien owned by the defendant,- Cherk Steinstra, and is presented by the following facts.

The defendant and appellant, Cherk Steinstra, obtained a judgment against Gottlieb Fischer which was docketed in the district court of Stutsman county on June 15, 1931.
