At the time of his death this suit was pending- on the docket of the district court of San Augustine county, filed by him against appellant, Traders’ & General Insurance Company, to set aside an adverse award of the Industrial Accident Board wherein he was employee and' Kurth-Ziegler Lumber Company of Veach, San Augustine county, v^as employer, and appellant the insurer.
