HAMITER, Justice.

Plaintiff, Robert Lee Ortego, is appealing from a judgment sustaining an excep tion of no cause of action (directed at the allegations of his petition) and rejecting his demands. In the suit he, as the sole heir of his deceased father, Eloi Ortego, seeks to recover an undivided interest in a tract of land of about 42 acres located in Evangeline Parish which was sold by his mother in 1920 and is now possessed by the defendant, Linzy Morein. The plaintiff alleges and contends that such land was the property of the community of acquets and gains that existed between his father…
