Yann sued the National Life & Accident Insurance Company upon a policy dated the 17th day of May, 1926, issued upon the life of Mrs. Carrie S. Yann in the siim of $270, and 12 .per cent, penalty and reasonable attorneys’ fees. The National Life & Accident Insurance Company denied liability by reason of the terms of the policy, and alleged:
