GARDNER, Circuit Judge.
This was an action at law brought by appellee as plaintiff to recover $4,000 from appellant. Plaintiff recovered judgment and defendant prosecutes this appeal. This is the second appeal in this case, the opinion on thé prior appeal being reported as Current News Features, Inc., v. Pulitzer Publishing Company, 8 Cir., 81 F.2d 288, where the facts are set out in considerable detail.
