ELLIS, Judge.

This is a tort action brought by Leroy J. David against Curtis E. Blalock and his liability insurer, Southern Farm Bureau Casualty Insurance Company, seeking damages for personal injuries.

The case came on for trial before a jury, when the plaintiff dismissed his suit against Blalock and proceeded to trial against the insurance company, which resulted in a verdict for the plaintiff. The trial judge granted a motion for a new trial and upon a joint motion of counsel for plaintiff and defendant, the matter was submitted to the trial court upon the record.
