The appeal in this case is from an order of the district court overruling a demurrer filed by garnishee who had denied liability to an answer of the principal defendant. The facts disclosed by the record may be stated as follows:

The plaintiff Reed obtained a judgment against the defendant Ziegler on October 17, 1951, for $923.40, and cost, for damages arising out of an automobile accident.
