Appeals (1) from a judgment of the County Court of Broome County (Smith, J.), rendered November 6, 2000, upon a verdict convicting defendant of the crimes of assault in the second degree, hindering prosecution in the second degree and resisting arrest, and (2) by permission, from an order of said court, entered August 7, 2001, which denied defendant’s motion pursuant to CPL 440.10 to vacate the judgment of conviction, without a hearing.
