This action was brought to recover damages for injuries received by the plaintiff, alleged to have been caused by a defect in a gutter at the, intersection of certain streets in the defendant city, by reason of which a wagon loaded with hay upon which the plaintiff was riding was overturned, inflicting the injuries complained of. The case has been tried three times. The first trial was had before Judge Stewart, in the Bane county circuit court, and resulted in a verdict for $3,000 in favor of the plaintiff.
