GOLDBERG, Circuit Judge:

This appeal is from an order denying to Don Garriga Chapman post-conviction relief pursuant to 28 U.S.C. § 2255. Chapman is currently serving a ten year sentence for unlawfully attempting to enter a federal banking institution with intent to take money therefrom, in violation of 18 U.S.C. § 2113(a). This court affirmed Chapman’s conviction on direct appeal. United States v. Chapman, 435 F.2d 1245 (5th Cir. 1970), cert. denied, 402 U.S. 912, 91 S.Ct. 1392, 28 L.Ed.2d 654 (1971).
