This case arises from the following facts. John Ringling was married to Emily Ringling (nee Emily Buck) in December, 1930. Four days before the marriage, Emily Buck loaned her fiance $50,000, taking his open note therefor and on the day of the wedding, they entered into an antenuptial agreement which will be discussed later. In July, 1933, John Ringling filed suit for divorce which he dismissed September 1, following.
