Reversing.
James E. Chilton died testate on October 22, 1927, at the age of 88 years. His wife had died on March 25, 1925. He left the bulk of his estate to Shelby Roberts, a nephew of Mrs. Chilton. A contest of the will was instituted by Mr. Chilton’s collateral heirs, and the trial resulted in a judgment in favor of the propounders which was affirmed on appeal to this court. Shelley v.
