1Opinion of the CourtJustice Hopf

Petitioner Elinor Nuyen appeals from the denial of her amended petition to remove the Old Second National Bank of Aurora (OSNB) from its position as executor of her deceased husband’s estate, pursuant to section 23 — 2 of the Probate Act of 1975 (Ill. Rev. Stat. 1979, ch. IIO/2, par. 23 — 2). The petition was brought in her capacity as representative of the beneficiaries of the estate and contended that OSNB had a conflict of interest, had wasted assets and had mismanaged the estate. After a hearing the circuit court of Kane County ruled in favor of OSNB.
