This matter comes to this court on an appeal after the following had occurred:

The respondent, Dan Filippini, made application, in the form prescribed by statute, to the office of the state engineer to appropriate a portion of the waters of Duff Creek, situate in Eureka County, Nevada. The appellant, Dewey Dann, filed a protest. The state engineer proceeded to make a field examination, and thereafter issued a “ruling” granting the application.
