MONROE, C. J.

Defendant, having been indicted on October 6, 1917, for rape, and called for trial, challenged the array of petit jurors on the grounds:(1) That O. E. Guillory, who participated as clerk of court and ex officio jury commissioner in the drawing of the jurors, had thereafter been appointed a member of the “local board,” created by the act of Congress of May 18, 1917, and by his acceptance of that federal office had, ipso facto, vacated the state offices held by him, by reason whereof and of his participation therein the drawing in question was illegal and of…
