STAKELY, Justice.

This is an appeal from a decree of the equity court sustaining the demurrer to the bill of complaint. The bill was'filed by Joe P. Mullins and others, as taxpayers of Etowah County, Alabama, and as members of the Board of Trustees of John S. Jones Junior High School against the Board of Education of Etowah County, Carl Q. Baxter, as Superintendent of Education of Etowah County, and John Alex Burns and others .as members of the Board of Education of Etowah County.
