Tbe plaintiff commenced this action in tbe District Court of Weber County, to recover • $3,950 damages in consequence of tbe failure of tbe defendant to deliver certain cattle at Green River, in tbe State of Wyoming, as required by a contract made in tbe State of Idaho. Tbe defendant appeared by bis attorneys and answered the complaint, admitting tbe contract set up in tbe complaint, and tbe breach thereof, and tbe amount due except $50.00, which be also admitted on tbe trial.
