Bankruptcy Code § 1325(a)(3) provides that the court shall confirm a Chapter 13 plan if the plan “has been proposed in good faith....” 11 U.S.C. § 1325(a)(3). Despite the inherent generality and impreciseness of the nondefined term “good faith,” courts of appeals have typically included the requirement that the bankruptcy court inquire whether the debtor is unfairly manipulating the Bankruptcy Code.
