On August 14, 1931, complainant filed its bill which averred that it was a public utility operating under a certificate of convenience and necessity issued by the Illinois commerce commission granting to complainant the right to operate busses in the transportation of persons between Chicago and Harvey and other towns in and outside of Cook county, Illinois; and that defendant without such certificate was operating a number of busses and competing with the business of complainant to its financial injury.
