“This is a suit brought by appellee, assurance-corporation, to set aside an award of the Industrial Accident Board by reason of the death of C. Moffett, while employed by Simmons & Pearce, in Caldwell county, Tex., on May 15,. 1924, the said death growing out of, and incident to, the said Moffett’s line of employment, the basis of the Industrial 'Accident Board’s award being that Simmons & Pearce, a copart-nership composed of W. J. or Joe Simmons and W. B. Pearce, had taken out compensation…
