The defendant was convicted of the murder of James S. Gilliam and sentenced to death at the Summer, term, 1911, of the Court of General Sessions for Newberry county. While the main reliance is on alleged errors in the charge, the appeal as first presented contained only isolated excerpts from the charge, the proposed case was not assented to by the solicitor, and there was nothing to show that it was ever served on him.
