Appeal from County Court, Payne County; Wilberforce Jones, Judge. W. D. Peyton was convicted of unlawfully conveying intoxicating liquors, and punishment assessed at a fine of $50 and 30 days’ imprisonment in the county jail, and he appeals.

W. D. Peyton was convicted in the county court of Payne county of the crime of unlawfully conveying intoxicating liquors, and his punishment fixed at a fine of $50 and 30 days’ imprisonment in the county jail. From this judgment of conviction, he has appealed to this court, and has assigned numerous errors, all of which are without substantial merit, except, one, which is treated in this opinion as the basis for reversal of the judgment.
