Procedural Background

National Loan Investors, LP (“NLI”) appeals from an order by the bankruptcy court entering judgment in favor of the Debtor-Appellee, Eileen M. LaPointe (“LaPointe” or “Debtor”). Before the bankruptcy court were two related matters, an objection to claim and a separate adversary proceeding, both pertaining to NLI’s attempt to collect a deficiency following the prepetition foreclosure sale of real estate located in Ashland, Massachusetts.
