This suit was instituted by Dave H. Culberson against the St. Louis Southwestern Railway Company of Texas, to recover damages, alleged to have resulted to appellee's 132 head of cattle through the alleged negligence of appellant while transporting same over its line of railway from Fort Worth, Tex., to Oglesby and Gatesville, Tex. Some of said cattle were killed in transit, others died shortly after arrival because of alleged injuries sustained during shipment, and all were alleged to have been injured by the negligence of appellant, by reason of being kept in open pens and exposed to the sun…
