Donmac Golf Shaping Company, Inc. (Donmac) filed an action against Glens Falls Insurance Company seeking a declaratory judgment that the insurance company is obligated under a “commercial general liability” policy to provide it with a defense and coverage for liability for the alleged negligent placement and construction of a golf course project partly on federally protected “wetlands” without obtaining necessary permits to do so.
