MEMORANDUM OPINION AND ORDER
JOHN H. PRATT, District Judge.
This case is before the Court on defendants’ motion to dismiss, or in the alternative, for summary judgment, and on plaintiff’s motion for summary judgment. Plaintiff, Stephen B. Kurylas, D.Y.M., seeks declaratory and injunctive relief as well as damages for alleged employment discrimination due to his national origin.
