Tbis is a bill in equity to compel the specific performance of a written contract dated June 8, 1898, whereby, it is claimed, the *230defendant by his agent, Mr. J. O. Carter, agreed to sell and the plaintiff agreed to buy the property known as Kahuku Ranch, situated on the island of Hawaii, for $100,000, namely, $1,000 paid upon the signing of the contract, the balance to be paid upon delivery of the deed as follows: $19,000 cash and plaintiff’s note for $80,000 endorsed by C. Brewer & Co., a corporation, payable September 1, 1898, with interest at six per cent.,…
