MEMORANDUM OF DECISION
LYNCH, District Judge.
This matter came on for hearing on August 25, 1982 on the parties’ cross-motions for summary judgment. The above-entitled cases were related and both involve judicial review of a final decision of the Administrator of the Health Care Financing Administration (“Administrator”) 1 denying Medicare reimbursement to the plaintiff non-profit hospitals. Both hospitals challenge the Administrator’s refusal to allow reimbursement of Hill-Burton free care costs. Mt.
