These consolidated appeals concern Rivercross, a building on Roosevelt Island owned as a Mitchell-Lama cooperative corporation. As a limited-profit housing company, Rivercross’s ownership and operation is governed by the Private Housing Finance Law. For present purposes, tenant rentals are governed by the income of individual tenants, with “over-income” tenants obliged to pay rental surcharges proposed by the company/co-op board and approved by the Division of Housing and Community Renewal (DHCR).
