Mullen, J., at jury trial and sentencing), rendered October 26, 2010, as amended December 10, 2010, convicting defendant of criminal possession of a controlled substance in the fifth degree, and sentencing him, as a second felony drug offender, to a term of four years, unanimously affirmed.
