MARTHA HILL JAMISON, Justice.

In this groundwater diversion case, appellant Ted Lazarides appeals the trial court’s denial of a motion for summary judgment in which he asserted various challenges to the trial court’s subject-matter jurisdiction. In seven issues, 2 Lazar-ides contends the trial court erred by refusing to dismiss appellee Grady Farris’s claims against Lazarides for conduct in his official capacity.
