BRYAN, Judge.
The Alabama State Personnel Board (“the Board”) and the Alabama Department of Conservation and Natural Resources (“the Department”) appeal from a judgment of the Montgomery Circuit Court reversing the Board’s decision upholding the Department’s dismissal of Allan V. Garner. We reverse and remand.
In February 2004, the commissioner of the Department terminated Garner’s employment with the Department. The Department held a pretermination hearing before Garner’s dismissal. Garner appealed his dismissal to the Board, pursuant to § 36-26-27(a), Ala.Code 1975.1 The Board assigned the…
