The plaintiffs are an owner of a retail package store and a wholesaler of wines. Defendant is the New York State Liquor Authority (“SLA”), charged by the New York state legislature with intrastate regulation and administration of the alcoholic beverage industry. Plaintiffs allege that *9Section 101-b of the New York State Alcoholic Beverage Control Law (the “ABC” Law) conflicts with Section 1 of the Sherman Act, 15 U.S.C. § 1, and is thereby constitutionally invalid pursuant to the Supremacy Clause.
