Based upon all the files, records and proceedings herein,

IT IS HEREBY ORDERED that the petition of Larry Richard Hackler for further review of the unpublished decision of the Court of Appeals be, and the same is, granted for the limited purpose of vacating petitioner’s conviction of assault in the second degree on the ground that it is a lesser included offense of the offense of assault in the first degree, of which petitioner was convicted on the basis of the same conduct.
