Allen & Scott, Inc., was the owner of an apartment building in the city of Tulsa and was personally liable for the mortgage debt thereon. Allen & Scott, Inc., conveyed the property to H. C. Stahl, and the present controversy is whether Stahl thereby assumed and agreed to pay the balance remaining due on the mortgage debt, or, on the other hand, merely bought the equity of Allen & Scott in the property without assuming personal liability on the debt.
