' On December 28, 1933, Fred Paul. died testate, a resident of Lexington, Ky. He was in Ms fortieth year. Four years prior thereto he was divorced from Ms then wife, the next friend appellee, Norma Meade Paul, to whom he was married about the year 1925. Before that divorce there was born to him and his wife the appellee, Freddie Lucille Paul, who was some 3 years of age at the time the divorce was granted, and she was the only issue of the marriage.
