LEMLEY, District Judge.

This cause having been tried to the Court and submitted upon the pleadings, the evidence produced in open court, and written briefs, and the Court being well and fully advised doth file this memorandum opinion, incorporating herein its findings of fact and conclusions of law.

The plaintiff, a citizen of Arkansas, brought this action as administratrix of the estate of her deceased husband, A. F.
