Plaintiff in error, hereinafter called plaintiff, owned certain real estate in Chatsworth, Illinois, on which there was a livery barn. On February 25, 1909, he advertised the same for sale subject to a mortgage of $2,500, the purchaser to pay $500 cash on the day of sale, and the balance ten days from that date on delivery of the deed and abstract, possession to be given On the date of sale upon receipt of contract and payment of the $500.
