MEMORANDUM OPINION AND ORDER

CLARKE, District Judge.

This action was brought by the City of Virginia Beach, Virginia, seeking indemnification from its insurance carrier, the Aetna Casualty and Surety Company, for losses incurred by the City as a result of a judgment rendered against it in favor of owners of property abutting a waterway project in which the City was involved with the Federal Government.
